The meeting opened with the Pledge of Allegiance.
Floor opened to the public.
Monthly reports of the Department heads were submitted and received.
Upon a motion by Mr. __________, seconded by Mr. __________ and unanimously carried, the minutes of the September 25, 2023 meeting were approved as presented.
Upon a motion by Mr. __________, seconded by Mr. ________ and unanimously carried, authorization was given for payment of the following vouchers, as audited:

7:35PM – Public hearing for Preliminary Budget. Upon a motion by Mr. ________ seconded by Mr. _________ and unanimously carried, Town Board approved to recess the regular meeting and open the public hearing. Budget Officer Kiefer will highlight the proposed budget and proposed tax rates. (Discussion regarding the Preliminary Budget) With everyone wishing to be heard and having been heard, Mr. ___________ moved to declare the public hearing closed and approved to re-enter into regular session. Motion seconded by Mr. ________ and unanimously carried.
The following resolution was offered by Mr. __________ who moved the adoption to wit:
RESOLUTION APPROVING PRELIMINARY BUDGET WITHOUT AMENDMENTS
RESOLVED, that such Preliminary Budget hereby is adopted as the Annual Budget of this Town for the fiscal year beginning on the first day of January, 2024, and that such budget as so adopted be entered in detail in the minutes of the proceedings of this town, BE IT FURTHER RESOLVED, that the Town Clerk of this Town shall prepare and certify in duplicate copies of said annual budget as adopted by this Town Board, together with the assessment rolls for benefit improvements, if any, adopted pursuant to Section 202-a, subdivision 2 of the Town Law and deliver one copy thereof to the Supervisor of this Town, that of which is to be presented by him to the County Legislature. Upon a motion by Mr. ________ seconded by Mr. ________ and unanimously carried, the Town Board hereby sets a public hearing for November 13, 2023, at 7:35PM, Hanover Town Hall for a one (1) year renewal of the following fire protection contracts and/or fire contract (Irving) for the year 2024 to be paid in full after all contract stipulations have been completed and the Town Supervisor has received his tax monies from the tax collector:
D#1 – Forestville - $35,204
D#2 – Hanover Hose - $59,216
Irving Fire District - $57,514
Perrysburg Fire - $2,500
Sunset Bay Fire - $37,579
Forestville - $30,501

Upon a motion by Mr. __________ seconded by Mr. ___________ and unanimously carried, the Town Board approved a Town Road-Cut Permit application to install a sewer line from 12841 Pleasant Avenue to the manhole located at the intersection of Pleasant Avenue and West Erie Street, Irving, NY, for the builder, Kevin Veith. The $2,000 bond will be paid by cash before construction begins. The application has been approved by a Code Enforcement Officer, the Water/Sewer Superintendent and the Highway Superintendent.
WHEREAS, the Town Court is requesting authorization from the Town Board to apply for funding from the Justice Court Assistance Program (JCAP) during the upcoming grant cycle; and
WHEREAS, one required component of this application is a resolution from the Hanover Town Board authorizing the Hanover Town Court to apply for this funding,
NOW THEREFORE, on a motion by Mr. __________, seconded by Mr. __________ and unanimously carried,
BE IT RESOLVED, that the Board of the Town of Hanover authorizes the Hanover Town Court to apply for a JCAP grant in the 2023-24 grant cycle up to $30,000.00.
Upon a motion by Mr. __________ seconded by Mr. __________ and unanimously carried, the Town Board authorized the following Planning and Zoning Board members to attend Southern Tier West Fall training on November 15, 2023, at Jamestown Community College, 525 Falconer Street, Jamestown, NY, and to pay each of their $20.00 registration fees, mileage expense and tolls for traveling to the training. All reimbursements are subject to present/existing town policies:

Mr. __________ moved to approve a proposed updated 5-G agreement for the shared Assessor’s Office services to add the Town of Portland to the original group of four (4) towns that are currently sharing the services. The motion was seconded by Mr. ___________, with a roll call vote as follows:

Upon a motion by Mr. __________ seconded by Mr. __________ and unanimously carried, the Town Board approved the purchase of one (1) new Cat 289D3 Compact Track Loader with hydraulic quick coupler, with the following additional options, from Milton CAT, 400 Wheeler Street, Tonawanda, NY, at the NYS contract purchase price of $101,782.00:
This Tracker Loader is priced using NYS OGS Group 40625, Award 22792, NYS Contract PC69406, making formal bidding under NYS GML S 103 unnecessary.
Correspondence from:
-Chautauqua County Supreme Court – Notice of Claim, with the Town of Hanover as Defendant, alleging $245.01 in gas line damages caused by a Town of Hanover employee, on August 18, 2023, at 6 Water Street, Forestville, NY.
-NYSDEC – notification letter regarding a wetland boundary delineation field visit conducted on property located on King Road and County Line Road, parcels 85.00-1-14 and 85.00-1-15 to determine whether wetlands present within and adjacent to the parcels met NYSDEC criteria for state wetlands jurisdiction. The determination was that there are no state-regulated freshwater wetlands jurisdiction.
